Fuels Capital is a brand within 0TO9 AB (556976-4110), which was founded in 2016 and has offices in Stockholm. The business is carried out through 0TO9 AB, which is a credit market company authorised to conduct financing operations pursuant to the Act (2004:297) on Banking and Financing.

We need to process your personal data in order to conclude contracts with you as a customer, with possible partners and suppliers and to subsequently administer the agreements. In addition, we process the data in order to meet the requirements imposed on us as a credit market company and to be able to further develop our business. We process personal data for the purposes and based on the legal grounds set out below.

Unless otherwise specified, Fuels Capital (0TO9 AB), org.nr. 556976-4110, is the data controller for the processing of your personal data.

A. When lending

We process personal data about you as a customer when you apply for and sign a loan with Fuels Capital (0TO9 AB). The table below shows how Fuels Capital (0TO9 AB) processes personal data when lending.

1. Contact and identity information

For example, name, social security number, contact details and identification by bank ID.

Provide our lending services. For example, to examine, administer and process your loan application. In order to be able to conclude and fulfill loan agreements with you.

For example, information about your family relationships and work, which you provide to us.

3. Correspondence

Written (e.g. chat and e-mail) and oral (recorded telephone conversations) communication with us regarding your loan application and in handling your loans, such as your answers to our questions related to the loan application.

Provide our lending services. For example, to examine, administer and process your loan application. In order to be able to conclude and fulfill loan agreements with you.

Fulfillment of contracts. The processing is necessary for the conclusion or performance of the loan agreement with you.

4. Entries in paragraphs 1 to 3 above

Purpose

Communication with you as a customer.

For example, to be able to notify you of changes in terms and conditions, notify about interest payment, interest rate changes and amortization, etc.

Fulfillment of contracts.

The processing is necessary for the conclusion or performance of the loan agreement with you.

5. Financial data

For example, the existence of bank accounts, account transactions, payroll, credits and liabilities, existing loans, credit and creditworthiness data, investments and similar information. The data is collected from our partners.

Purpose

Provide our lending services.

For example, to examine, administer, process and decide on your loan application in order to be able to conclude and fulfill loan agreements with you and comply with consumer law requirements. During the contract period with you, Fuels Capital (0TO9 AB) will also continue with the credit monitoring.

Legal basis

Legal obligation.

Compliance with legal obligations under the Consumer Credit Act (2010:1846), where Fuels Capital (0TO9 AB) must obtain certain information about you in order to comply with consumer law requirements when lending. For example, the law requires Fuels Capital (0TO9 AB) to assess whether you have the financial means to fulfill your commitment.

6. Account information

Information from bank accounts, account transactions, etc. The data is collected from partners of Fuels Capital (0TO9 AB).

Purpose

Conducting credit tests.

For example, to be able to obtain account information about you in order to carry out credit assessments.

Legal basis

Consent.

Fuels Capital (0TO9 AB) only collects account information about you, through partners, for the purpose of conducting credit checks and if you have consented to this. Please note that if you do not consent to your account information being collected for the purpose, Fuels Capital (0TO9 AB) cannot provide the loan services.

Conducting customer knowledge checks.

For example, to comply with legal requirements such as controls on money laundering and terrorist financing.

Fulfilment of legal obligations under Act (2017:630) on anti-money laundering and terrorist financing measures and fulfilling Fuels Capital's (0TO9 AB) obligations under Finansinspektionen's rules on e.g. customer knowledge and monitoring of transactions.

8. Data necessary for our customer knowledge checks

For example, whether you or someone close to you is a politically exposed person (PEP) or subject to sanctions, presence in public records such as SPAR, as well as information about judgments and occurrences of Kronofogden. The information is collected from our partners as well as public and private registers.

Purpose

Conducting customer knowledge checks.

For example, to comply with legal requirements such as controls on money laundering and terrorist financing

Legal basis

Legal obligation.

Compliance with legal obligations under the Act (2017:630) on anti-money laundering and terrorist financing measures and fulfilling Fuels Capital (0TO9 AB)'s obligations under the Financial Supervisory Authority's rules on, for example, customer knowledge and monitoring of transactions.

9. Information in paragraphs 1 to 8 above.

Protect Fuels Capital (0TO9 AB) against or bring a legal claim.

Legal basis

Fulfillment of contracts.

If the processing is necessary for the performance of a contract (e.g. if Fuels Capital (0TO9 AB) considers that you are not complying with the agreement between us), we rely on it as a legal basis.

Should the claim be unrelated to the agreement, Fuels Capital (0TO9 AB) supports a balance of interests, in which our legitimate interest consists in being able to defend Fuels Capital (0TO9 AB) against legal claims or bring legal claims.

How Fuels Capital (0TO9 AB) obtains the personal data

Fuels Capital (0TO9 AB) collects the personal data set out in paragraphs 1—3 above primarily from you and the data you have provided to Fuels Capital (0TO9 AB). Fuels Capital (0TO9 AB) can also collect and verify the data against public registers, such as SPAR. Where applicable, Fuels Capital (0TO9 AB) may also obtain and verify basic identity data from digital signature solution providers (e.g. BankID) or equivalent.

The personal data referred to in paragraphs 5, 6 and 8 above are obtained from Fuels Capital (0TO9 AB) from partners as well as from registries, other banks and credit institutions.

Recipients of the personal data

Fuels Capital (0TO9 AB) only shares personal data withother parties to the extent necessary to provide Fuels Capital (0TO9 AB)'s services, if you have requested it or if required by law. Fuels Capital (0TO9 AB) does not sell personal data to third parties.

Fuels Capital (0TO9 AB) will share your personal data with the company's data processors in the following situations:

1. Personal data is shared with our digital signature solution providers (e.g. bank ID) and IT providers (such as core banking system providers, IT system and operations providers);

2. Fuels Capital (0TO9 AB) also transfers information about you to our partners, who, where appropriate, handle your contact in connection with your application and after-sales management;

3. Your financial information is shared with our partners and providers of information and analysis services in order to carry out customer knowledge checks. In such communications, we will endeavour to psedonymize or anonymize the data.

Fuels Capital (0TO9 AB) may also share your personal data with subsidiaries. Recipients of the personal data specified herein are the data controllers for their respective personal data processing.

Fuels Capital (0TO9 AB) transfers control data to the Swedish Tax Agency and other authorities in accordance with law.

Furthermore, Fuels Capital (0TO9 AB) transfers necessary and relevant personal data to Fuels Capital (0TO9 AB)'s partners in order to:

1. Obtaining account information in accordance with paragraph 6 above;

2. for loan financing and debt collection; and

3. for the disposal of claims from dismissed customers (forward flow).

Automated decisions that significantly affect you

In order to be able to examine your application for a loan, Fuels Capital (0TO9 AB) needs to carry out an analysis of your financial situation in order to make a decision on granting a loan. Fuels Capital (0TO9 AB) also needs to carry out customer knowledge checks in accordance with the money laundering legislation, as described above.

Such checks may be carried out through automated decisions in part or throughout the credit assessment process, which involves profiling based on personal data set out in the table above, comparing your financial circumstances and transactional behaviour against the conditions and behaviours that indicate risks for Fuels Capital (0TO9 AB) as a lender (e.g. risk of fraud or money laundering).

An automated decision means decisions that are made automatically without personal contact. An automated decision affects you to a significant degree. You have the right to object to an automated decision, as well as the profiling that takes place in connection with the decision making. If you object to an automated decision, one of Fuels Capital (0TO9 AB)'s employees will check that the decision has been made correctly.

B. Marketing

Fuels Capital will process personal data about you for the purpose of informing you about Fuels Capital's services. Your personal data is processed, among other things, in order to provide you with relevant and customized communications and marketing, which is described in more detail below.

When you use the services of Fuels Capital (0TO9 AB), Fuels Capital (0TO9 AB) in some cases processes your personal data for profiling, i.e. an automated processing of personal data to assess certain personal characteristics of you, in order to be able to send customized marketing to you via social platforms. This means that Fuels Capital (0TO9 AB) assesses certain of your personal characteristics through automated processing of your personal data, such as personal preferences and behaviours. How long is the personal data stored?

The Accounting Act (1999:1078) requires that financial data needed as a basis for accounting be kept for seven years in addition to the current year.

According to the Act (2017:630) on Money Laundering and Terrorist Financing, Fuels Capital (0TO9 AB) shall store transaction data for at least five years, and sometimes up to ten years, after the transaction has been executed. Data on customer knowledge shall be stored for five years from the end of the contractual relationship between Fuels Capital (0TO9 AB) and the customer. Due to the fact that there is a legal requirement to save its personal data, it is not possible for the customer to withdraw his consent regarding this personal data or request that it be deleted.

For personal data stored with a balance of interests as the basis, a periodic review of whether the personal data should continue to be stored is carried out. When it is no longer necessary to store them for the purpose of treatment, they will be thinned out. If the customer has withdrawn the consent for the storage of personal data, the storage will cease as soon as possible for the personal data stored on the basis of consent. Regarding data for an application to become a customer that has been rejected, Fuels Capital (0TO9 AB) saves it for 90 days in order to be able to comply with the requirements of the Consumer Credit Act on notification of reasons for refusal and to ensure that the company can meet requirements for government reporting. After 90 days, the data on a rejected application will be deleted automatically. In connection with the application for a loan, an income verification by consent to the collection of account information may have been made by the applicant. Account information will be deleted immediately in the event that an applicant withdraws consent.

If you are a customer of Fuels Capital (0TO9 AB), Fuels Capital (0TO9 AB) will store your personal data for as long as is necessary to fulfill its purpose.

In light of the aforementioned laws, Fuels Capital (0TO9 AB) may store customer personal data for up to 10 years from the termination of the business relationship between the customer and Fuels Capital (0TO9 AB), but they may be stored for a shorter period depending on the different types of personal data and the purposes for which they are stored. Personal data that is processed to protect us from or to make legal claims is processed until the statute of limitations occurs, typically ten years from the date the claim arose.

However, when we share your information with, for example, an IT provider operating outside the EU/EEA, your personal data may be processed outside the EU/EEA. If and when your data is processed outside the EU/EEA, we ensure that there is an adequate level of protection and that appropriate safeguards are in place (for example through the use of the EU Commission's standard contractual clauses). You have the right to know how we handle your personal data

You do not have the right to request information about anyone other than yourself. For security reasons, the data will be sent home to your registered address or, if possible, as a message via My Pages or.

You have the right to withdraw your consent

You may at any time, by contacting Fuels Capital (0TO9 AB)'s DPO by e-mail info@fuelscapital.com, withdraw your consent to Fuels Capital's (0TO9 AB) personal data processing, where consent is used as the legal basis. If you withdraw your consent, Fuels Capital (0TO9 AB) will terminate the processing and storage that you previously consented to. Please note that this does not apply to personal data that Fuels Capital (0TO9 AB) processes based on other legal grounds, such as legal requirements or the re-processing is necessary to fulfill an agreement between you and Fuels Capital (0TO9 AB).

You can request that the personal data be completed or corrected

In such cases, indicate which data you would like to be completed or corrected. Please state the reasons for your request. Fuels Capital (0TO9 AB)'s DPO will without delay take a position on your request and any changes that Fuels Capital (0TO9 AB) believes you are entitled to. While Fuels Capital (0TO9 AB) is reviewing your request, you have the right to request that Fuels Capital (0TO9 AB) does not continue to process your personal data.

In some cases, you may object to the processing of your personal data by Fuels Capital (0TO9 AB)

You have the right to object to the processing of your personal data by Fuels Capital (0TO9 AB), in cases where the personal data is processed on the basis of balancing of interests as a legal basis. Fuels Capital (0TO9 AB)'s DPO will assess without delay whether Fuels Capital (0TO9 AB) has a compelling legitimate reason for continuing the processing other than your interest in the non-processing of the data, or whether the continued processing is necessary for the establishment, exercise or defence of legal claims. If the DPO of Fuels Capital (0TO9 AB) considers that there is no reason for such consideration, Fuels Capital (0TO9 AB) will cease the processing of the personal data in question.

As stated in Section A above in connection with Fuels Capital (0TO9 AB)'s examination of the loan application, you have the right to object to an automated decision that significantly affects you, as well as the profiling that takes place in connection with the decision making. If you object to an automated decision, one of Fuels Capital (0TO9 AB)'s employees will check that the decision is correct.

In addition to the above, you also have the right to object to direct marketing (e.g. mailings about offers, news, etc.) that we send to you based on balancing of interests as a legal basis. If you object to receiving such mailings, Fuels Capital (0TO9 AB) will cease sending such information to you. You also have the right to object to profiling for marketing purposes (see section C above), in addition to, of course, withdrawing your consent to the processing of personal data.

In some cases, you may request the transfer of your personal data

In some cases, you have the right to data portability, which means that you have the right to have your personal data that you have provided to Fuels Capital (0TO9 AB) transferred to yourself or to someone else, such as another creditor. If you request this, Fuels Capital (0TO9 AB) will transfer the personal data to the one you specify in a structured, commonly used and machine-readable format.

Please note that this right applies only to data that you yourself have provided to Fuels Capital (0TO9 AB) and where the processing of personal data constitutes consent or agreement with you as the legal basis. Complaints

If you, as a Customer or applicant, do not believe that Fuels Capital (0TO9 AB) has processed your personal data correctly, you are welcome to first submit your comments to us by e-mail complaints@fuelscapital.com.

If you believe that Fuels Capital (0TO9 AB) has not been able to assist you in the way you wish and believe that Fuels Capital (0TO9 AB) should do so by law, you can lodge a complaint with IMY, which is the supervisory authority for personal data processing.

On IMY's website, www.imy.se you can find further information on how to proceed if you wish to make a complaint. Your complaint becomes a general document, which means that anyone has the right to hear what you write to IMY as long as the data in your complaint is not protected by confidentiality. If you wish to remain anonymous, the advice is to submit the complaint by regular mail without revealing your own personal data.
